I od on xanax, not intentionally and I was taken to a mental hosp. Am I considered 50/50? ?

first time I took xanax 2 mg which caused a severe effect on me. I dont remember anything after taking the pill, but my bf told me that I stuffed my mouth with a lot of xanax. Paramedics were called and I was declared dead upon arrival. Now I stayed at the hospital overnight and then I was taken to a mental hospital where I spoke with a psychologist which released me same day. Im pregnant now and my bf claims that he can take our baby from me because im declared 50/50. Can he really do that through court? He says judge will be on his side, even thou the od was unintentional?
